1. General

1.1 General Terms and Conditions

These general terms and conditions (“Terms”) apply when you, as a consumer (“You”), place an order via www.skinome.com (the “Website”). The agreement is entered into between you and Skinome Research AB, company registration number 559164–0189 (“Skinome”). Detailed contact information and other information about Skinome are available on the Website. These Terms apply only to consumers who place orders through the Website.

1.2 Minimum Age of 18

To place an order on the Website, You must be at least 18 years old. In accordance with Swedish law, Skinome does not accept credit purchases from persons under the age of 18. Skinome reserves the right, in individual cases, to reject or amend your order, for example if You have provided incorrect personal information and/or have a record of payment defaults.

1.3 Reservations

Skinome reserves the right to sell out of products and for any image or typographical errors on the Website, including errors in product descriptions or technical specifications, incorrect prices and price adjustments, such as changes in supplier prices or exchange rates, as well as incorrect information regarding product availability.

Skinome has the right to correct such errors and to amend or update information at any time. If an incorrect price has been stated for a product You have ordered, Skinome will inform you and await your approval of the corrected price before proceeding with the order.

All images on the Website are intended solely as illustrations. Such illustrations cannot be guaranteed to accurately reflect the number of products You receive, or the exact appearance, features or origin of a product. Skinome is not responsible for information on the Website provided by third parties.

1.4 The Website and Its Content

The Website and all content on it are owned by Skinome or its licensors. The information is protected, among other things, by intellectual property and marketing laws.

This means that trademarks, company names, product names, images and graphics, design, layout, and information about products, services and other content may not be copied or used without Skinome’s written approval.

2. Agreement and Order

2.1 Purchase Terms

To make a purchase through the Website, You must accept these Terms. By accepting the Terms, You agree to comply with them in full and confirm that You have reviewed the information concerning personal data and consented to the use of personal data and cookies in accordance with Skinome’s Privacy Policy.

2.2 Purchase Agreement

A purchase agreement is entered into only once Skinome has confirmed your order and You have received an order confirmation from Skinome by email. Skinome recommends that You retain this order confirmation for any future contact with Skinome’s customer service.

You may withdraw your order until it has been confirmed by Skinome. If the order is withdrawn, Skinome will refund any payments made in respect of the order by You or your payment or credit card provider.

2.3 Order Confirmation

After you place an order, you will receive an order confirmation at the email address you provided as soon as your purchase has been approved.

3. Customer Information etc.

3.1 Customer Information

When You register your user account and/or place an order, You will be asked to provide certain personal information. You confirm that the information You provide is accurate and complete and You are responsible for any incorrectly entered information.

Information about Skinome’s processing of personal data is available in Skinome’s Privacy Policy, see section 15.

3.2 Protecting Your Information

You undertake to ensure that no one else can use your login details. You must not disclose your username or password to any unauthorised person and must ensure that any document or information containing your username and password is stored in such a way that unauthorised persons cannot gain access to it.

You must notify Skinome immediately if there is reason to suspect that an unauthorised person has gained access to your password. You are responsible for all purchases made using your login details if such notification has not been given.

3.3 Misuse of Account

If Skinome suspects that You are misusing your user account or login details, or otherwise breaching these Terms, Skinome has the right to suspend your account. Skinome also has the right to issue You with new login details.

4. Prices, Fees and Payment

4.1 Prices on the Website

For orders placed through the Website, the prices stated on the Website apply. For the EU/International market, prices are stated in euro (EUR) and always include VAT. Prices do not include any applicable shipping charges, which are stated separately at checkout.

4.2 Payment

Skinome has the right to charge payment at the time the order is placed. Skinome reserves the right not to offer all payment methods at all times, or to change the payment method if the method You have selected does not work for any reason at the time of purchase.

Any restrictions relating to available payment options are stated on the Website.

4.3 Payment Methods

We accept payment by Visa, Mastercard, Swish, PayPal, Apple Pay, Google Pay, Qliro Pay Later, Vipps, Trustly, MobilePay, iDEAL | Wero, Bancontact and UnionPay. When you make a payment, it is processed by our payment partners to ensure a fast and secure payment process.

4.4 Refunds

For returns, your refund may appear on your account statement within 14 banking days from the day you received your return confirmation from us. Refunds are always made to the same payment card used for the purchase.

5. Campaigns and Offers

Skinome may from time to time offer campaigns on the Website with more favourable terms than those set out in these Terms, for example in relation to payment or an extended right of withdrawal.

These more favourable terms apply for as long as the campaign is active and only to the specific products identified by Skinome in connection with the campaign.

Skinome reserves the right to withdraw such campaigns at any time. When a campaign ends or is withdrawn, these Terms apply without modification. Offers on specific products on the Website are valid for a limited period and while stocks last.

6. Delivery and Transport

6.1 Shipping

We deliver throughout the EU and to Norway.

6.2 Delivery Time

Products that are in stock are normally delivered within the number of business days stated when you select the delivery method for your order. Sections 6.4 and 6.5 also specify the estimated delivery time for each delivery option.

Unless otherwise expressly agreed, you have the right to cancel the purchase if delivery takes more than 14 days and the delay is not attributable to you as the customer.

6.3 Collecting Your Package

If your package is delivered to a collection point, You must collect it within the period stated in the collection notification. Packages should normally be collected in person upon presentation of valid identification and your order number.

You will always receive a notification stating where and when the package can be collected. Notifications may be sent by email or regular mail and, if You have provided your mobile phone number, also by telephone or SMS.

6.4 Delivery Options for Subscription Orders

We always offer free shipping on subscription orders.

The following delivery options are available depending on the delivery destination:

DHL Service Point – 3–5 business days

DHL Home Delivery – 3–5 business days

UPS Home Delivery – 3–5 business days

FedEx Home Delivery – 3–5 business days

Delivery options may vary depending on the delivery destination.

The delivery option You select for your first subscription order will apply to all subsequent recurring subscription orders. If You would like to change your delivery option, please contact us at info@skinome.se.

6.5 Delivery Options for One-Time Purchases

The following delivery options are available depending on the delivery destination:

DHL Service Point – 3–5 business days

DHL Home Delivery – 3–5 business days

UPS Home Delivery – 3–5 business days

FedEx Home Delivery – 3–5 business days

Delivery options may vary depending on the delivery destination.

7. Right of Withdrawal

7.1 Right of Withdrawal

When purchasing products through the Website, you always have a 14-day right of withdrawal in accordance with applicable consumer protection legislation. This means that you have the right to withdraw from your purchase by notifying Skinome within 14 days from the date on which you, or a person designated by you, received the ordered product (the withdrawal period).

7.2 Exercising the Right of Withdrawal

When exercising your right of withdrawal, the product must be returned within 14 days from the date on which you notified Skinome of your decision to exercise the right of withdrawal.

The product must be securely packaged and returned in good condition. Returns must be made to Skinome in accordance with the methods and instructions specified by Skinome under section 8.

7.3 Costs and Diminished Value

When You withdraw from your purchase, Skinome will refund the amount You paid for the product, excluding any applicable return costs.

Skinome is also entitled to deduct from the amount to be refunded an amount corresponding to any diminished value of the product compared with its original value, if and to the extent that such diminished value is the result of You handling the product beyond what is necessary to establish its nature, characteristics or functionality.

7.4 Refunds

Skinome will issue the refund as soon as possible, but no later than 14 days from the date on which we received your return and sent you a return confirmation by email.

The refund will be made using the same payment method that you used when purchasing the product, unless otherwise agreed or there is an obstacle preventing such a refund.

8. Returns

8.1 Returns

When exercising your right of withdrawal, the products must be unused and unopened for the return to be accepted. For a return to be valid, you must also have received the package or collected it from the designated collection point.

A package that is not collected and is automatically returned to us is not considered a valid return, and we may charge an additional fee in accordance with section 8.3.

If the products are damaged or have been used, no refund will be issued. Always check that your shipment is undamaged upon delivery.

You can register your return or complaint here. Enter your email address and order number and follow the instructions.

For returns, we charge a €9 return fee.

For an approved return or complaint, we will refund the amount of your order within 14 days.

8.2 Uncollected Packages

If you do not collect your package and it is automatically returned to us, we will charge an additional fee for the additional handling costs. We may also need to dispose of the product.

As our skincare products are fresh, it is important to collect your package as soon as possible if you have chosen delivery to a collection point.

For uncollected orders, we charge a €19 fee.

9. Complaints

9.1 Right to Make a Complaint

The right to make a complaint applies to products that are defective in accordance with applicable consumer protection legislation. If you discover that a product is defective when you receive your order, you should contact Skinome as soon as possible, but no later than 14 days after receiving your order.

Register your complaint here, after which we will contact you.

Complaints made within two months from the date on which You discovered the defect are always considered to have been made within a reasonable period of time. You have a three-year right to make a complaint regarding products purchased through the Website.

9.2 Compensation in the Event of a Complaint

Once the product subject to the complaint has been returned and the complaint has been approved, Skinome will compensate You in accordance with applicable consumer protection legislation.

Skinome aims to process this within 30 days of receiving the complaint, although in some cases it may take longer.

Skinome reserves the right to reject a complaint if it is determined that the product is not defective under applicable consumer protection legislation.

When handling complaints, Skinome follows the guidelines of the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), see www.arn.se. More information is available at www.konsumentverket.se.

10. Applicable Law and Disputes

10.1 Handling of Disputes

Disputes shall in the first instance be resolved amicably following discussion with Skinome’s customer service (info@skinome.se).

10.2 If a Dispute Cannot Be Resolved

If a dispute cannot be resolved amicably with Skinome’s customer service, you as a customer may refer the matter to ARN (Allmänna reklamationsnämnden). More information is available at www.arn.se.

In the event of a dispute, Skinome follows decisions issued by ARN or an equivalent dispute resolution body.

10.3 Disputes Concerning the Terms

Disputes concerning the interpretation or application of these Terms shall be interpreted in accordance with Swedish law and resolved in accordance with section 13.2 above or, as a last resort, by a court of general jurisdiction.

These Terms were adopted by Skinome on 29 March 2020.

11. Links

Skinome may link to other websites that are outside Skinome’s control, and websites outside Skinome’s control may link to the Website.

Although Skinome seeks to ensure that Skinome only links to websites that follow Skinome’s privacy and security principles in accordance with the Privacy Policy, Skinome is not responsible for the protection or confidentiality of information or personal data that You provide on other websites.

You should exercise caution and review the privacy provisions of the relevant website.

12. Force Majeure

Skinome is not responsible for delays caused by circumstances beyond Skinome’s control, including, for example, general labour disputes, war, fire, lightning strikes, terrorist attacks, changes in government regulations, technical problems, failures in electricity, telecommunications or data connections or other communications, as well as errors or delays in services provided by subcontractors due to such circumstances.

Such circumstances shall constitute grounds for exemption from liability for damages and other sanctions. If such circumstances continue for more than two months, both You and Skinome have the right to cancel the purchase with immediate effect.

13. Amendments to the Terms

Skinome reserves the right to amend these Terms at any time. All amendments to these Terms will be published on the Website.

Amendments apply from the time You accept the Terms in connection with a new purchase or when visiting the Website, or alternatively 30 days after Skinome has informed you of the amendments.

Skinome nevertheless recommends that You regularly review the Website to stay informed of any amendments to the Terms.

14. Severability

If a competent court, authority or arbitration tribunal determines that any provision of these Terms is invalid or unenforceable, the relevant provision and all other provisions shall remain valid and enforceable to the extent permitted by applicable law.

Provisions declared invalid or unenforceable will be replaced in accordance with relevant legal guidance and advice.

15. Privacy Policy

15.1 Your Personal Data and How We Process It

When you entrust Skinome Research AB with your personal data, it is important to us that you feel confident and secure. We are committed to protecting your privacy. Your personal data is processed with the utmost care and in accordance with applicable legislation.

This Privacy Policy describes how we collect and process your personal data when you visit our Website and use the services offered through it.

All processing of personal data is carried out in accordance with the General Data Protection Regulation (GDPR). The data controller is Skinome Research AB (company registration number 559164–0189), with its address at Hornsgatan 172, 117 28 Stockholm.

When you place an order, you agree that we may store and use your information in order to fulfil and provide the service you can expect from us.

15.2 What Is Personal Data?

Personal data means information and data that can be directly or indirectly linked to a living individual.

Examples of personal data include your name, personal identity number, address, email address and telephone number. It may also include customer numbers, encrypted information and various types of electronic identifiers, such as IP addresses.

Any operation performed on personal data constitutes processing, regardless of whether it is carried out by automated means. Common examples of processing include collection, recording, organisation, structuring, storage, modification, transfer and deletion.

15.3 What Information Do We Collect and Why?

Information You Provide When You Become a Customer of Skinome Research AB

When you become a customer of Skinome Research AB, we collect your contact details: name, email address, telephone number, address, delivery method, any applicable collection point and IP address.

The purchase agreement we have entered into with you constitutes the legal basis for processing your personal data and the processing is necessary in order for us to fulfil our legal obligations and perform the agreement with you, for example in relation to delivery and payment.

Information Collected When You Contact Us

When you contact us, for example by email, contact form or chat, we collect the personal data you provide to us.

We do this so that we can answer your questions and handle your enquiry. This may include information such as your name, email address and order number.

We also collect information that you choose to provide to us concerning, for example, your health or medication.

If your enquiry concerns a complaint, we process your information in order to fulfil our obligations under applicable consumer protection legislation. The legal basis for this processing is the purchase agreement entered into with you.

15.4 How Do We Use Your Information?

Performance of an Agreement

We process your information to identify you as a customer, process and deliver your order, and manage invoicing and payment.

We also process your personal data so that we can assist you if you contact us with questions, comments or, for example, a complaint.

Information About Products and Services

We use your personal data for SMS and email communications containing information about our products and services, inspiration and educational content relating to skin and skincare.

You may withdraw your consent to receive newsletters, SMS messages, campaigns and offers at any time by contacting us or by using the unsubscribe link provided in each newsletter and SMS.

If you choose to participate in the registration process on skinome.com or provide personal information on other occasions, the information you provide may be used to create and send direct marketing to you.

Direct marketing includes all forms of marketing, such as our regular email list, SMS messages and postal communications, which may include campaigns, special discounts, new product launches, upcoming updates, skincare advice, product recommendations and other relevant information (“Opt-In Communications”).

We will never disclose your information to unauthorised parties or sell it to external parties.

15.5 Who Do We Share Personal Data With?

Payment Solutions

Legal basis: Performance of the purchase agreement.

In order to receive payments and manage invoices and payments, we share information with Shopify and Klarna.

Shopify and Klarna collect personal data about you in connection with payment. Shopify and Klarna are therefore data controllers for this information in accordance with their respective terms.

Carriers/Shipping Providers/Unifaun

Legal basis: Performance of the purchase agreement.

Our shipping providers receive the personal data necessary to process and deliver your order.

Google/Facebook

Legal basis: Legitimate interests.

We share analytics data through third-party cookies for marketing and web analytics purposes in order to improve our services.

We do not record information about visitors’ IP addresses; therefore, information about you cannot be linked to your identity.

We use Google Analytics to improve the content, navigation and structure of the Website. The analytics tool uses JavaScript and cookies, and information about your use of the Website is anonymised.

To prevent information from being stored, you can choose not to accept cookies in your browser.

Direct Marketing

Legal basis: Customer consent.

To send you information about our products and services, we use an external CRM system in which we store your email address.

You can unsubscribe at any time, either via the link in the newsletter or by contacting us directly at info@skinome.se.

Public Authorities

Legal basis: Exercise of official authority and performance of a task carried out in the public interest.

Upon request, we may be required by law or by a decision of a public authority to disclose certain personal data, for example to the police in connection with a criminal investigation.

Other Recipients

Legal basis: Legitimate interests.

Where appropriate, we may transfer your personal data to recipients other than those specified above if this is necessary for our business operations.

A high level of security and confidentiality is maintained whenever personal data is processed.

We may also share information with prospective purchasers if we sell all or part of our business or in connection with a merger.

15.6 Recruitment and Personnel Administration

This applies to the processing of job applications and potential employment, termination of employment, and the administration of any rehabilitation or discrimination-related matters.

  • Contact details for references

Legal basis: Legitimate interest in carrying out or concluding recruitment processes and, where applicable, retaining information to protect our interests in discrimination-related matters or similar cases. Explicit consent where sensitive personal data may be involved.

Retention period: 60 months from the date of collection or completion of the recruitment process.

Following Up References During Recruitment

If someone provides contact details for references during the recruitment process, we only retain the reference’s name, telephone number and email address.

We retain this information until the recruitment process has been completed.

16. Cookies

16.1 What Are Cookies?

Cookies are small text files consisting of letters and numbers that are sent from our web server and stored in your browser or on your device.

16.3 How Long Do We Retain Your Personal Data?

We retain personal data for as long as there is a legal basis, a documented purpose for the processing or an ongoing customer relationship.

We have ongoing procedures in place to ensure that we do not retain unnecessary personal data and we minimise retention periods as far as possible.

As a general rule, we retain your customer information for a maximum of three years following your most recent contact with us.

However, information that must be retained under applicable accounting legislation is stored for up to eight years.

16.4 How Do We Protect Your Personal Data?

We have implemented appropriate security measures to protect your personal data against loss, misuse and unauthorised access.

The number of people who have access to your personal data is limited. Only individuals within our organisation who need to process your personal data have access to it.

Service providers with whom we share personal data will only process it on our behalf and in accordance with our instructions.

16.5 Your Rights Regarding Your Personal Data

You have the right to request information about the personal data that Skinome Research AB holds about you and to request that such data be deleted.

To access this information or request deletion of your personal data, your request must be made in writing, include your full name and personal identity number, and be signed by you.

You can always use the unsubscribe link included in all campaigns, offers and newsletters that we send to you.

If your information is incomplete, inaccurate or irrelevant, you have the right to request that it be corrected or deleted.

You also have the right to claim compensation if your personal data has not been processed in accordance with applicable law.

Information that cannot be deleted includes, among other things, data that must be retained under applicable accounting legislation and data required for Skinome Research AB to fulfil its obligations, for example in connection with complaints.

It is important to us that you feel confident in how we process your personal data. We are committed to protecting your privacy and always strive to process your personal data with the utmost care.

If you nevertheless believe that we are processing your personal data incorrectly, you are welcome to contact us.

You may also submit a complaint to the Swedish Authority for Privacy Protection (Integritetsskyddsmyndigheten), which is the supervisory authority responsible for monitoring the processing of personal data.

Skinome Research AB reserves the right to amend this Privacy Policy at any time to the extent necessary to address issues or comply with new legal and technical requirements.

Any changes to this Privacy Policy will be published on the Website.
